Terms of Service

1. Introduction

1.1 Purpose of the Agreement

These Terms and Conditions (“Terms”) govern your access to and use of Summn’s mobile application (“App”) and the services provided by Summn (“We”, “Our”, “Us”). By accessing or using the App, you agree to be bound by these Terms.

1.2 Acceptance of Terms

By creating an account or using the App, you agree to comply with these Terms. If you do not agree with these Terms, you must not use the App.

1.3 Modification of Terms

We reserve the right to modify or revise these Terms at any time. Any changes will be effective once the revised Terms are posted in the App or on the website. Continued use of the App after changes constitutes acceptance of the revised Terms.

2. Account Creation and User Obligations

2.1 Account Creation

To use Summn, you must create an account by providing the following information:

  • Full Name
  • Date of Birth
  • Email Address
  • Password

You agree to provide accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

2.2 Eligibility

You must be at least 13 years old to create an account and use the services. If you are under 18, you must have the consent of a parent or guardian.

2.3 User Obligations

By using the App, you agree not to:

  • Violate any laws, including intellectual property rights and data protection regulations.
  • Use the App for unlawful, fraudulent, or harmful purposes.
  • Engage in any activity that could harm other users, including harassment, defamation, or spamming.

2.4 Account Security

You are responsible for securing your account information. If you suspect unauthorized use of your account, you must notify us immediately.

3. Services Provided by Summn

3.1 Core Features

Summn allows users to create, join, and share events and activities, especially spontaneous or last-minute activities (e.g., a game of beach volleyball). Upon creation of an event, notifications are sent to interested users based on their preferences and location.

3.2 Location-based Services

In order to provide relevant notifications to users, we collect and store your device’s location. Location data is used solely for matching users to events in their vicinity.

4. Permissions and Data Usage

4.1 Required Permissions

  • Location Access: For personalized notifications of nearby events.
  • Microphone Access: To allow users to create events quickly via voice.

4.2 Data Collection and Use

We collect various types of personal data to provide our services:

  • Account Data: Name, email, password, date of birth
  • Event Participation Data: Activities created or joined, notifications sent and received, ratings
  • Location Data: Location coordinates when you use the App to generate or join events
  • Analytics Data: Information about your device, app usage, and interactions with the App for performance analysis

4.3 Third-Party Data Storage

Your data is stored by MongoDB Atlas, a third-party service provider. MongoDB stores your data in secure cloud infrastructure. Please refer to their privacy policy for further details.

5. User Rights and Responsibilities

5.1 Content Ownership

You retain ownership of any content (including text, images, and other media) you upload to the App. However, by uploading content, you grant Summn a worldwide, royalty-free, non-exclusive license to use, display, modify, and distribute your content in connection with the App’s operations.

5.2 Prohibited Activities

You agree not to:

  • Post, upload, or transmit any content that is offensive, abusive, defamatory, or otherwise harmful.
  • Engage in any activity that could damage or disable the App’s infrastructure.
  • Attempt unauthorized access to the App’s systems or data.

5.3 Suspension and Termination

We reserve the right to suspend or terminate your account if we suspect any violation of these Terms, including abuse of features or illegal conduct. You may also request the deletion of your account at any time.

5.4 Request for Account Deletion

To request account termination and data deletion, send an email to support@summn.app. We will process your request in accordance with applicable data protection laws.

6. Termination of Services

6.1 Termination by User

You can terminate your account at any time by sending an email to support@summn.app. Upon termination, we will delete your personal data, subject to legal obligations.

6.2 Termination by Summn

We may suspend or terminate your access if we believe you have violated these Terms, including actions that violate the privacy of other users or compromise the security of the App.

7. Disclaimers and Limitation of Liability

7.1 Service Availability

While we strive to provide uninterrupted service, we do not guarantee the availability of the App at all times and are not responsible for any downtime or interruptions.

7.2 Limitation of Liability

Summn is not liable for any direct, indirect, incidental, or consequential damages arising from your use or inability to use the App, including but not limited to damages resulting from loss of data, privacy violations, or third-party interactions.

8. Governing Law and Dispute Resolution

This Agreement shall be governed by and construed in accordance with the laws of Switzerland. Any disputes shall be resolved in the competent courts of Switzerland.
